EB-5 US IMMIGRATION INVESTMENT

EB-5 (Employment-Based Fifth Preference)

The EB-5 investment program allows foreign entrepreneurs to invest in a project or a business in the US to receive a green card for the whole family and become US Permanent Residents with an investment amount of $800,000 USD or $1,050,000 USD.

    •  Invest $800,000 USD in a Targeted Employment Area (TEA) or rural area, or in a project supported by the Government.

    •  Invest $1,050,000 USD in a Non - Targeted Employment Area or into an existing business operating in the United States under a franchise or establishing a new business.

EB-5 investments must create at least 10 full-time jobs for U.S. Citizens or Permanent Residents.

EB-5 Investment Forms

Investment through regional center: The total cost of the EB-5 process includes a minimum investment amount of $800,000 USD for projects located in a designated Targeted Employment Area (TEA), including rural and high unemployment areas, or $1,050,000 USD if located outside of these areas.

Direct EB-5: EB5 direct investment is any form of investment made without going through a regional center with an investment amount of $1,050,000 USD or more. Some forms of direct investment include:

    •  New business formation

    •  Acquiring an existing business;

    •  Invest in an existing business.

Registration process

    •  I-526 submission: File Form I-526 (Immigrant Petition by Alien Investor) with USCIS along with proof of investment.

    •  Pending Processing: USCIS reviews and approves the I-526 petition.

    •  I-485/DS-260 submission: After the I-526 Petition is approved, if the investor is in the US, they will file an I-485 Application to Register Permanent Residence or Adjust Status. If they are outside the US, they will file a DS-260 (Application for Immigrant Visa and Alien Registration) through the US Consulate.

    •  Conditional Green Card: When the I-485 or DS-260 application is approved, the investor and family will receive a conditional green card valid for 2 years.

    •  I-829 submission: Before the 2-year expiration date, the investor files an I-829 (Petition by Entrepreneur to Remove Conditions on Permanent Resident Status) to remove the 2-year green card conditions and receive a permanent green card.
